PRIVACY AND COOKIE POLICY FOR THE WEBSITE http://www.drobinyczasu.pl

§ 1. General provisions

  1. The privacy and cookie policy for the website http://drobinyczasu.pl (hereinafter: “Policy”) has been drawn up and adopted by Drobiny Czasu Magdalena Czaplińska.
  2. The terms used in the Policy mean:
    1. Website: the website http://drobinyczasu.pl;
    2. User: a person using the publicly accessible Website;
    3. Owner: Drobiny Czasu Magdalena Czaplińska, ul. Górczewska 200c, flat 458, 01-460 Warsaw, 01-460 Warsaw, 852-228-03-33, 142607670;
    4. Cookies: text files sent by the Website and stored on the User’s end device, which the User uses whilst browsing websites. The files contain information necessary for the proper functioning of the Website. Cookies most often contain the domain name of the website from which they originate, the duration of their storage on the end device, and a number;
  3. The purpose of the Policy is, in particular:
    1. to provide Users with information regarding the use of Cookies on the Website, as required by law, including the Telecommunications Law;
    2. to ensure Users’ privacy protection to an extent consistent with the standards and requirements set out in applicable legal provisions.
  4. The Owner limits the collection and use of information concerning Users to the minimum necessary to provide services to them.
  5. In order to gain full access via the Website to the content and services offered by the Owner, it is advisable to accept the terms set out in the Policy.
  6. The following legal provisions apply, amongst others:
    1. the Act of 16 July 2004 – Telecommunications Law (Journal of Laws 2017.1907, consolidated text, as amended);
    2. the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2017.1219, consolidated text, as amended);
    3. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016) together with Polish data protection legislation.

§ 2. Protection of privacy and personal data

  1. Data concerning Users is processed by the Owner in accordance with the law. Personal data of Users obtained by the Owner is processed on the basis of consent given by the User or the existence of another legal basis authorising the processing of data in accordance with the law, in particular the Regulation. The controller of your data is Drobiny Czasu Magdalena Czaplińska.
  2. The Owner takes particular care to protect the interests of data subjects and, in particular, ensures that such data is:
    1. processed lawfully, fairly and in a transparent manner in relation to customers and other data subjects;
    2. collected for specific, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes;
    3. adequate, relevant and limited to what is necessary for the purposes for which they are processed;
    4. accurate and, where necessary, kept up to date;
    5. stored in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the personal data are processed;
    6. processed in a manner that ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures;
  3. The Data Controller shall implement appropriate technical and organisational measures to ensure that the personal data being processed are protected in a manner appropriate to the nature, scope, context and purposes of the processing, as well as the risk of infringement of the rights or freedoms of natural persons.
  4. The Owner strives to systematically update the IT, technical and organisational measures used to protect such data; in particular, the Owner ensures updates to IT security measures to protect against viruses, unauthorised access and other threats arising from the operation of the IT system and telecommunications networks.
  5. The Owner ensures access to data and the exercise of other rights by data subjects to any User who has provided their data to the Owner in any way, in accordance with the applicable legal provisions in this regard; such persons are entitled to:
    1. the right to withdraw consent to the processing of personal data;
    2. the right to information regarding their personal data;
    3. the right to control the processing of data, including the right to supplement, update, rectify and delete it;
    4. the right to object to processing or to restrict processing;
    5. the right to lodge a complaint with a supervisory authority and to use other legal remedies to protect their rights.
  6. The Owner may process personal data by automated means, including through profiling, in accordance with the principles set out in the Regulation. In such cases, the Owner’s activities are aimed at marketing purposes or the need to personalise communications sent to Users (including tailoring information to the User’s needs or expectations). The User has the right to object to such processing of their data – this objection may be expressed by sending a message to the Owner’s address: rejestracje@DrobinyCZasu.pl.
  7. A person with access to personal data processes it solely on the basis of the Owner’s authorisation or a data processing agreement and solely on the Owner’s instructions.

§ 3. Cookies

  1. Cookies identify the User, which allows the content of the website they are using to be tailored to their needs. By remembering their preferences, they enable the appropriate tailoring of content directed at them, including advertisements. The Owner uses Cookies to ensure an appropriate standard of convenience on the Website, and the data collected is used solely within the company for the purpose of optimising operations.
  2. Cookies are used for the following purposes:
    1. tailor the Website’s content to the User’s preferences;
    2. optimise the use of the Website, in particular by recognising the User’s device;
    3. compiling statistics;
    4. maintain the User’s session;
    5. deliver advertising content to the User.
  3. Cookies may be placed on the Website User’s device.
  4. The data collected is used to monitor and analyse how Users use the Website, in order to improve its functionality and ensure more effective and seamless navigation.
  5. Please note that in some cases, beyond the Owner’s control, software installed by the User on their device for browsing websites (e.g. a web browser) enables the default storage of cookies on the User’s device. Users may change their cookie settings at any time. These settings may be altered, amongst other things, to block the automatic setting of cookies or to notify the User each time they are placed on the User’s device.   6. The User may at any time disable or re-enable the collection of cookies by changing the settings in their web browser.
  7. Changing the settings constitutes an objection, which may cause difficulties in using the Website in the future. Completely disabling the option to accept cookies will not prevent you from viewing the content published on the Website, with the exception of content that requires logging in to access.
  8. Failure to change the settings means that data will be stored on the User’s device (using the Website will result in cookies being automatically stored on the User’s device).
  9. The stored data placed on the User’s device does not cause any configuration changes to the User’s device or the software installed on that device.
  10. Information regarding Cookies also applies to other similar technologies used within the Website.

§ 4. Final provisions

  1. This Policy has been adopted by order of the Owner and comes into force on 25 May 2018. Amendments to the Policy may be made in the same manner.
  2. Any deviations from the Policy must be in writing, otherwise they shall be null and void.
  3. The Policy shall be governed by the laws of the Republic of Poland.
  4. In matters not covered by the Policy, the relevant provisions of law shall apply.
